Agreement

By creating an account or using any Arcadia Servers service, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all users, including trial accounts.

Services

Arcadia Servers provides web hosting services including shared WordPress hosting and virtual private servers (VPS). We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We will provide at least 30 days' notice before discontinuing a service, except where required by law or to prevent harm.

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials. Do not share your password.
  • You must provide accurate account and billing information and keep it up to date.
  • You are responsible for all activity that occurs under your account, including actions by any users you grant access to.
  • Notify us immediately at [email protected] if you suspect unauthorised access to your account.

Acceptable Use

You may not use our services to:

  • Distribute malware, ransomware, spyware, spam, or phishing content
  • Host content that infringes on third-party intellectual property rights
  • Conduct or facilitate denial-of-service attacks, port scanning, or any unauthorised access to third-party systems
  • Run cryptocurrency or proof-of-work mining operations of any kind
  • Operate open proxies, VPN exit nodes, or Tor exit nodes
  • Send bulk or unsolicited email. Outbound port 25 (SMTP) is blocked by default on all plans.
  • Host botnet command-and-control infrastructure or malware distribution endpoints
  • Conduct IP spoofing or traffic amplification attacks
  • Violate any applicable local, national, or international law

We reserve the right to suspend or terminate accounts that violate this policy without prior notice. If you receive an abuse report or DMCA takedown notice relating to content on your account, we will forward it to you and expect a response within 48 hours.

Billing & Payments

  • Subscriptions are billed in advance on a monthly or annual cycle.
  • All prices are listed in USD and are exclusive of any applicable taxes unless stated otherwise.
  • Failed payments will trigger a grace period of 7 days before service suspension.
  • You may cancel your account at any time. Cancellation takes effect at the end of the current billing period; we do not offer pro-rated refunds for partial months.
  • Annual plans are eligible for a refund within 14 days of initial purchase.

Uptime & Service Levels

We target 99.9% monthly uptime across all services, excluding scheduled maintenance windows. Scheduled maintenance is announced at least 24 hours in advance. For VPS plans, the uptime commitment covers the underlying hardware and network — not the customer's operating system, installed software, or self-inflicted outages. For extended unplanned outages exceeding our SLA, we offer account credits at our discretion — contact support to request a review.

Data & Backups

Backup provision depends on your service:

  • WordPress Hosting: Automatic weekly backups are included and retained for 30 days.
  • VPS: No automatic backups are provided unless purchased as an add-on. You are solely responsible for backing up your data.

Regardless of plan, backups are provided as a convenience and we do not guarantee their completeness or recoverability. You should maintain your own independent copies of any critical data. We are not liable for data loss.

Limitation of Liability

To the fullest extent permitted by law, Arcadia Servers' total liability arising out of or related to these terms or the services shall not exceed the fees you paid us in the 3 months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.

Termination

Either party may terminate the agreement at any time. We may terminate your account immediately for material violations of these terms. Upon termination, your data will be available for export for 30 days, after which it will be permanently deleted.

Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.

Governing Law

These terms are governed by and construed in accordance with applicable law. Disputes will be resolved through good-faith negotiation first; if unresolved, through binding arbitration.
